What Changed for AY 2027-28 vs Previous Years

Frequently Asked Questions

Can the ITR due date be extended beyond July 31?

Yes, CBDT has extended the July 31 due date in several years—including FY 2019-20 (COVID) and some other years citing portal technical issues. However, extensions are not guaranteed. CA firms should plan to file all non-audit ITRs by July 25 to avoid the last-minute rush and portal congestion regardless of whether an extension comes.

What is the consequence of filing ITR-1 when ITR-2 was required?

Filing under the wrong ITR form is considered a defective return under Section 139(9). The income tax department will issue a defect notice (under Section 139(9)), and the taxpayer has 15 days to file the correct ITR. If not corrected, the original return may be treated as invalid—potentially triggering belated return status and Section 234F fees.

Is there a penalty for using belated return to claim a refund?

No penalty specifically for claiming refund in a belated return. However, refund with interest under Section 244A is calculated from April 1 of the AY (for TDS refunds) or from the date of payment of excess tax—so filing early maximizes the interest period on refund. Late filing fee under Section 234F applies regardless of refund or payable status.
